1. Introduction

1.1 This Terms of Use Agreement ("Agreement") governs your use of the Gigits mobile application and any related services provided by Grupo Innovador Gigits SA de CV ("Gigits"). By accessing or using Gigits, you agree to be bound by these terms. If you do not agree to these terms, please do not use Gigits.

2. User Account

2.1 To use Gigits, you may be required to create a user account. You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account. You agree to provide accurate and up-to-date information when creating your account.  

2.2 You agree to notify Gigits immediately of any unauthorized use of your account.

3. Information Collection and Use

3.1 Gigits collects personal information from you, such as your name, email address, birthday, and other information you choose to provide. We use this information to:

• Provide and improve our services.

• Personalize your experience.

• Communicate with you.

• Analyze and improve our services (usage data).

3.2 We may share your personal information with third-party service providers who assist us in operating Gigits, but only under strict contractual obligations regarding data security and privacy.

4. Content

4.1 Gigits may provide content, including but not limited to text, graphics, images, and software. You agree not to reproduce, modify, distribute, or display any content from Gigits without Gigits' prior written consent.

4.2 You are responsible for any content you upload or share through Gigits. You agree not to upload or share any content that is harmful, illegal, or offensive.

5. Intellectual Property

5.1 Gigits and its content, including but not limited to the software, design, text, graphics, and logos, are the property of Gigits or its licensors and are protected by copyright, trademark, and other intellectual property laws.

6. Disclaimer of Warranties

6.1 Gigits is provided "as is" without any warranties, express or implied. Gigits does not warrant that the app will be error-free, uninterrupted, or secure.

7. Limitation of Liability

7.1 In no event shall Gigits be liable for any indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with the use or inability to use Gigits. This includes damages for loss of profits, goodwill, data, or other intangible losses.  

8. Indemnification

8.1 You agree to defend, indemnify, and hold Gigits harmless from and against any claims, liabilities, damages, judgments, awards, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of Gigits or your violation of this Agreement.

9. Governing Law

9.1 This Agreement shall be governed by and construed in accordance with the laws of Mexico.

10. Changes to the Agreement

10.1 Gigits may update this Agreement from time to time. We will notify you of any material changes by posting a notice on the Gigits app or by other means. Your continued use of Gigits after the effective date of any such changes constitutes your acceptance of the revised Agreement.

11. Termination

11.1 Gigits may terminate this Agreement or your access to the Gigits app at any time, without notice, for any reason.
